By accessing or using the website of MoFangFeng Tech (Jinan Mofangfeng Electronic Technology Co., Ltd.) ("we," "our," or "us") at www.mofangfeng.shop (the "Site"), and by engaging our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, please do not use our Site or services.
These Terms constitute a legally binding agreement between you ("Client," "User," or "you") and MoFangFeng Tech. We reserve the right to update or modify these Terms at any time without prior notice.
MoFangFeng Tech provides professional services in the field of computer systems design and related services within the Professional, Scientific, and Technical Services sector. Our services include, but are not limited to: Computer systems design and architecture, Integrated systems engineering and deployment, Cloud infrastructure planning and management, Cybersecurity assessment and implementation, Data analytics and AI solutions, Technology consulting and strategic advisory, IT support and managed services.
The specific scope, deliverables, timelines, and fees for any engagement will be detailed in a separate Service Agreement or Statement of Work executed by both parties.
You agree to use our Site only for lawful purposes. Prohibited activities include: unauthorized access attempts, interference with site operation, introducing harmful code, scraping data without permission, and submitting false information.
All content, materials, designs, logos, text, graphics, software, and other intellectual property displayed on our Site are owned by or licensed to MoFangFeng Tech and are protected by applicable copyright, trademark, and other intellectual property laws.
Both parties agree to maintain the confidentiality of all non-public information disclosed during the course of the business relationship. This confidentiality obligation shall survive the termination of any Service Agreement for a period of five (5) years from the date of disclosure.
As a client of MoFangFeng Tech, you agree to: provide accurate and timely information, designate an authorized point of contact, make available necessary resources, review deliverables within agreed timeframes, and adhere to payment terms.
Fees for services will be outlined in the applicable Service Agreement. Unless otherwise agreed: invoices are due within 30 days, late payments may incur interest at 1.5% per month, all fees are exclusive of applicable taxes, and we reserve the right to suspend services for overdue accounts.
To the maximum extent permitted by law, MoFangFeng Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the total fees paid for the specific service giving rise to the claim during the twelve months preceding the event.
You agree to indemnify and hold harmless MoFangFeng Tech from claims arising from your use of our Site or services in violation of these Terms, violation of applicable law, infringement of third-party rights, or inaccurate information provided.
Our services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
Either party may terminate a Service Agreement with 30 days' written notice (for convenience) or immediately for material breach not cured within 15 days (for cause). Upon termination, you shall pay all fees due for services rendered up to the effective date.
Neither party shall be liable for delay or failure in performance resulting from causes beyond reasonable control, including acts of God, natural disasters, war, terrorism, government actions, pandemics, or infrastructure failures.
These Terms shall be governed by the laws of the People's Republic of China. Disputes shall first be resolved through good-faith negotiations. If negotiation fails, disputes shall be submitted to binding arbitration under CIETAC rules in Jinan, Shandong Province.
These Terms, together with any applicable Service Agreement, constitute the entire agreement between you and MoFangFeng Tech regarding the subject matter, superseding all prior agreements.
If any provision is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
No failure or delay in exercising any right shall operate as a waiver thereof.
